These Terms and Conditions (“Terms”) set out what applies when you book the 1:1 Consultation with Ania via mindfulmodels.de. “Ania” and “we” refer to the provider; “you” refers to the person making the booking.

Section 1 Provider and scope

(1) The provider of the 1:1 Consultation is Ania Wanda Karina Kawa, operating as the sole proprietorship “Modelmentoring Mindful Models,” Rosmarinweg 48, 70374 Stuttgart-Bad Cannstatt, Germany. Phone: +49 176 63388719, email: ania@mindfulmodels.de.

(2) These Terms apply to all contracts for the 1:1 Consultation concluded via our website. Anything we agree with you individually, for example by email, takes precedence over these Terms.

Section 2 Service

(1) Ania advises you personally in a 60-minute one-on-one video call about your path as a model – for example, on your portfolio, polaroids, agencies and getting started, positioning, next career steps, styling and how you present yourself, or concrete to-dos. Which topics are the focus depends on your request and on what you and Ania agree on during the call.

(2) Ania prepares for the call on the basis of your request and the links you have sent us; the preparation is included in the price. The consultation itself begins as soon as you and Ania are connected in the video call.

(3) The video call takes place via Cal Video, the video service of our booking partner Cal.com. You will receive the link with the booking confirmation. You need a device with a camera, a microphone, and an up-to-date browser, as well as a stable internet connection.

(4) Ania conducts the consultation personally and advises you to the best of her knowledge based on her experience in the modeling industry. She does not owe, and cannot promise, any particular result – such as being signed by an agency, jobs, or income. The consultation is not an application to Mindful Models’ scouting, nor is it placement with agencies or clients.

(5) The consultation is not legal, tax, or financial advice and does not replace medical or psychotherapeutic treatment. Ania discusses contracts, for example with agencies, only in general terms based on her industry experience; a legal review of your specific contract is not included. For that, please consult a lawyer.

Section 3 Booking and conclusion of the contract

(1) The description of the consultation on our website and Ania’s suggested appointment by email do not yet constitute a binding offer. Booking works in the following steps:

You submit a non-binding request using the form at mindfulmodels.de/en/consultation.
Ania reviews your request and sends you an appointment by email with a personal link to the booking page. The link is valid until the time stated in the email.
On the booking page, you see an overview of the service, appointment, price, and your details once more and make the necessary declarations, for example your acceptance of these Terms.
By clicking the “Book and pay now” button, you make a binding offer to conclude the contract. We confirm receipt of your booking by email; this confirmation of receipt does not yet constitute acceptance.
We then forward you to our booking partner Cal.com. Your appointment is already selected there: you enter your name and email address, confirm the appointment, and pay via the payment service provider Stripe.
As soon as the payment has been successful, Cal.com confirms the booking to you on our behalf, on screen and by email with the link to the video call. With this, we accept your offer and the contract is concluded. In addition, we send you a contract confirmation by email with these Terms, the information on the right of withdrawal, and the model withdrawal form.

(2) If you do not complete the appointment confirmation and payment at Cal.com, no contract is concluded and you incur no costs. You are bound by your offer only for as long as the booking link at Cal.com is valid, and for no more than 2 hours. If you complete the payment only after this period has expired, the contract is concluded only if Ania expressly confirms the booking; otherwise, we will refund the payment to you without undue delay. As long as Ania’s suggested appointment is valid, you can start the booking again using the link in her email.

(3) If the appointment has been given to someone else in the meantime, or if the booking cannot be completed for technical reasons, no contract is concluded. Ania will then get in touch with you with a new suggested appointment. If you have already paid in this case, we will refund the full amount to you without undue delay.

(4) Identifying and correcting input errors: Before you click, the booking page shows you an overview of the details from your request once more. If anything is incorrect, please do not book yet; instead, reply to Ania’s email or write to ania@mindfulmodels.de, and Ania will send you a corrected link. You can abort the booking at any time before clicking “Book and pay now” by closing the page. You can change your entries at Cal.com directly in the input fields before confirming.

(5) Contract text: We store the data of your booking, your declarations with the time they were made, and the version of these Terms that you accepted. After the contract has been concluded, we send you the contract text by email, containing your booking data, these Terms, and the information on the right of withdrawal – please save or print it. After that, you can no longer access your booking on our website. You can find the current version of these Terms at any time at mindfulmodels.de/en/terms, where you can also save and print them.

(6) The contract can be concluded in German or English. The contract language is the language in which you book: English if you book via the English pages of our website, German if you book via the German pages. We have not submitted to any special codes of conduct.

Section 4 Booking for minors

(1) If the person taking part in the consultation is under 18 years of age, a parent or other legal guardian books for them. If you book in this role, you conclude the contract in your own name for the benefit of the minor. You are then the contracting party: you book and pay, receive the contract documents, and can reschedule or cancel the appointment or withdraw from the contract.

(2) When booking, you declare that you are booking as a parent or legal guardian. Where necessary, please coordinate the participation with any other parent or legal guardian.

(3) You will be present at the start of the video call. If the participant is under 16 years of age, you will stay for the entire call. For participants aged 16 and 17, you may leave the call after it has started but will remain reachable until it ends.

(4) Ania will not begin the call without the required accompaniment; if it is missing later on, Ania will pause the call until you are back. The consultation nevertheless ends at the booked time. If you are not present at the start, Section 8 applies accordingly.

Section 5 Price and payment

(1) The consultation costs €149. This is the final price. Ania is a small business owner; under Section 19 of the German VAT Act (UStG), her sales are exempt from VAT. The price therefore includes no VAT, and no VAT is shown. We do not charge any additional costs; for the video call, you only need your own internet connection.

(2) You pay the price in advance when booking. The payment is processed by the payment service provider Stripe on Cal.com’s booking page. Accepted means of payment: credit and debit card. Stripe sends you the payment receipt by email.

(3) We make refunds using the same means of payment that you used for the payment, unless we expressly agree otherwise. We do not charge you any fees for the refund.

Section 6 Appointment and performance

(1) The booked appointment is binding on both parties. Ania reserves the time exclusively for you.

(2) Please check in good time before the appointment that your camera, microphone, and internet connection are working, and find a quiet place where you can talk without being disturbed. Be on time for the video call; you will find the link in the booking confirmation.

(3) The consultation lasts 60 minutes and ends at the booked time.

(4) Ania may end the call if, for good cause, she cannot reasonably be expected to continue it, for example in the event of insulting, discriminatory, or harassing behavior. This does not affect the statutory rights of either party.

Section 7 Rescheduling and cancellation by you

(1) Rescheduling: You can reschedule your appointment free of charge to another available time slot up to 24 hours before it starts. After that, rescheduling is only possible with Ania’s consent.

(2) Cancellation: You can cancel the consultation at any time until it begins and thereby terminate the contract. We will then refund the full price to you – without undue delay and no later than 14 days after we receive your cancellation. If you cancel at short notice, Ania will be happy to offer you an alternative appointment first; you do not have to accept it.

(3) Rescheduling and cancellation are to be communicated to us in text form, for example by email to ania@mindfulmodels.de or by letter; if the booking confirmation from Cal.com contains links for this purpose, you can also use them. The time at which your notice reaches us is decisive.

(4) Your right of withdrawal (Section 11) remains unaffected.

Section 8 No-show and late arrival

(1) If you do not attend the booked appointment and have not rescheduled or canceled it beforehand, the price remains payable under Section 615 of the German Civil Code (BGB), because Ania kept the time free for you. Ania will credit against the price anything she saves as a result, earns from using the time otherwise, or willfully fails to earn.

(2) If you are late, the consultation is shortened accordingly; it ends at the booked time and the price stays the same. Ania will wait at least 15 minutes. If you have not joined the video call by then and have not let her know, she may end the appointment; paragraph (1) then applies.

Section 9 Cancellation by Ania and technical disruptions

(1) If Ania has to cancel an appointment, for example due to illness, she will let you know as early as possible. You can then choose between an alternative appointment and a full refund of the price.

(2) If the consultation fails to take place in whole or in part because of a technical disruption that is not on your side – for example, on Ania’s side or at the video service – we will make up the lost time in an alternative appointment. If you do not want an alternative appointment, we will refund the price pro rata for the lost time, or in full if the consultation did not take place at all. If the remaining consultation is no longer of interest to you, we will refund the full price; your statutory rights remain unaffected.

(3) If the disruption is on your side, for example with your internet connection or your device, Ania will try to continue the call – if you both agree, also by other means, for example by phone. The lost time will not be made up and the price stays the same. If it cannot be determined where the disruption lay, paragraph (2) applies.

(4) Any further claims are governed by Section 12.

Section 10 No recording, confidentiality

(1) The video call is not recorded. Audio, image, or screen recordings, including screenshots, are only permitted if everyone involved has expressly agreed in advance – in the case of minors, the parent or legal guardian as well. You are of course welcome to take notes.

(2) Ania treats as confidential whatever you entrust to her for the consultation. She will not pass on your materials or information to third parties without your consent, not even to agencies, unless she is legally required to do so.

(3) Our privacy policy at mindfulmodels.de/en/privacy explains how we process your personal data.

Section 11 Right of withdrawal

(1) As a consumer, you have a statutory right of withdrawal of 14 days from the conclusion of the contract. The details are set out in the information on the right of withdrawal at mindfulmodels.de/en/right-of-withdrawal; you will also receive it with the contract confirmation. You can withdraw, for example, by email or online at mindfulmodels.de/en/withdraw-from-contract.

(2) If your appointment – including after rescheduling – begins before the withdrawal period has expired, the consultation will only take place if you have first expressly requested and agreed that Ania begin the consultation before the withdrawal period expires, and have confirmed that you are aware of the expiry of your right of withdrawal. Your right of withdrawal then expires as soon as the consultation has been fully performed. We ask you for this when you book; if you later reschedule the appointment to a date within the withdrawal period, we will ask you for this declaration by email. If we have not received it by the start, we will reschedule the appointment with you to a time after the withdrawal period has expired; if you do not want this, we will refund the full price.

(3) Until you and Ania are connected in the video call, you can withdraw free of charge within the withdrawal period. If you withdraw during the consultation, you pay the portion of the price that corresponds to the part of the consultation provided up to that point.

(4) The rules on rescheduling, cancellation, and no-shows in Sections 7 and 8 do not affect your right of withdrawal.

Section 12 Liability

(1) Ania is liable without limitation for intent and gross negligence, for damage resulting from injury to life, body, or health, under the Product Liability Act (Produkthaftungsgesetz), and to the extent that she has given a guarantee.

(2) In the case of slight negligence, Ania is liable only if she breaches an essential contractual obligation. Essential obligations are those whose fulfillment makes the proper performance of the consultation possible in the first place and on whose observance you may regularly rely. In this case, liability is limited to the damage that was typically foreseeable at the time the contract was concluded.

(3) These rules also apply to the liability of persons whom Ania engages to perform her obligations.

Section 13 Questions, complaints, and dispute resolution

(1) The best way to send questions and complaints is by email to ania@mindfulmodels.de; you can reach Ania by phone at +49 176 63388719. She will take care of them personally.

(2) We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

Section 14 Applicable law and version

(1) German law applies. If your habitual residence is in another country, you additionally retain the protection of the mandatory provisions of the law of that country (Art. 6(2) Rome I Regulation).

(2) Your contract is governed by the version of these Terms that you accepted when booking. Later changes apply only to new bookings.
